Why MSME Debt Recovery Works Under Indian Law

The MSMED Act 2006 provides strict statutory protection for registered MSME suppliers.

1. Mandatory 45-Day Payment Limit

Section 15 mandates that buyers must settle MSME invoices within agreed date or maximum 45 days. Any clause exceeding 45 days is legally void.

2. 3x RBI Bank Rate Interest

Section 16 mandates statutory compound interest with monthly rests at 3 times the RBI Bank Rate (~20.25% p.a.). Buyers cannot waive this requirement.

3. MSME Samadhaan Tribunal

If debtor fails to respond to our Legal Notice within 15 days, we directly file an ODR case on the state MSME Samadhaan Council portal.
